Hi Gil,

It is quite possible that Mr. Lipset hasn't seen this variation before since he is not as involved with the hobby as he used to be but it is definitely far from a 1/1 card.

I hadn't been following his auction but if someone paid over $9,000 for that card as reported on this thread then I feel bad for them because it just isn't nearly as rare as it was described.

I have to say that it's pretty lame that he left the statement "Never seen before" in the description after someone (Lee) contacted him and informed him that he had owned three of them. That's a HUGE ethical mistake and if I were the buyer I wouldn't pay for this item.

typical lew for the people that have been in the hobby for awhile. his words is gospel although in this case if the buyer finds out and comes back to lew in a reasonable time he'd probably get a refund.

This is typical of how Lew acts, which is why he has a bit of a shaky reputation now, but generally makes thing right if he's called on the BS. As is the sad case in this hobby, no matter how bad your reputation is, if you have the cards people want, they will keep coming back to you.

Lew is a great guy and has done great things for the hobby. I am sure he would do the right thing if it came down to it.
BUT if you are going to spend 10k you should know what you are doing-this is not on Lew it is on the buyer.
I am sure Lew thought is was 1 of 1 or he would not have listed it as so. I think the person that spent 10k on this is just like me spending $500 on a rare back I wanted! Just my opinion and I am sure others feel different.

Jim, that still doesn't excuse Lew from not making an amendment to the description after he was informed about it. Does anyone here honestly think that Rob Lifson would have handled this the way Lew did? True, buyers are ultimately responsible for the decisions they make, but when you are buying from someone like Lew, REA, etc you expect them to know what they are talking about and to set things right immediately when they are shown that they are wrong. If this was someone with lesser name recognition in the hobby, they would hung out dry and crucified for doing something like this.

Jay I agree with you, Rob would have handeled this different and Lew could have. I am sure with all the talk about this, the buyer will hear about it. I am interested to see the final outcome.
What would happen if a buyer did not pay the auction house?

I don't think Lew would have any recourse since it can be proven that he materially misrepresented the card.

lew would just block the bidder, like he's done to a few people...or they stopped dealing with him. not sure if it still applies but a few years back if u badmouth him on n54 ur automatically block

edited to add: personally i've had nothing but success dealing with him, and when calling he can be curt but nothing outrageous like some others have experienced.

Lew knows a lot about the hobby, and you'd think with that wealth of knowledge, he'd want to share some of it......sometimes.

My one personal experience with him was through email. I was trying to determine if a certain Tango Eggs card was truly a 1 of 1. The thought was that the card was originally in a PSA holder and then crossed over to SGC (I believe it was Dooin). I thought they were different from the start. So I emailed him to see if the one that he sold had always resided in an SGC holder. I told him that I was new to vintage card collecting and heard great things about him, and was really nice and cordial about it. His response was rather rude and short. But that being said, he did answer my question.

I found this whole thing rather curious that there were more responses to this poor auction description than the Other board, others would have been beat down silly yet Lew seems to get a pass. It is always a wonder how a mob works.

Wow - yeah, barely made a ripple over there. Odd. Everyone was all fired up to discuss the variation, but then much quieter on the Lipset auction, which I would have expected to generate a lot of further comment. As for me, I don't post there...I just lurk a little.
